1. Acceptance of Terms

By subscribing to the New Durham notification service ("Service"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not subscribe.

2. Service Overview

The Town of New Durham, NH ("the Town," "we," "us," or "our") uses the Service to send official, non-marketing notifications to residents who opt in, by email and/or SMS text message. Message categories are community updates, meeting notices, service notifications, and public notices. TownCloud Broadcast operates the Service on the Town's behalf as the messaging service provider.

3. Eligibility and Registration

To subscribe you must:

  • Be at least 13 years old.
  • Provide a valid full name.
  • Provide an email address if you choose "Email only" or "Both."
  • Provide a mobile phone number if you choose "SMS only" or "Both."

4. SMS Program Terms

Program name: Town of New Durham, NH Community Notifications

Program description: Informational text messages from the Town of New Durham, NH for community updates, meeting notices, service notifications, and public notices.

SMS is optional. You receive New Durham text messages only if you provide a mobile number, select "SMS only" or "Both," check the unchecked SMS consent box, and confirm your enrollment by replying YES to our confirmation text.

  • Message and data rates may apply.
  • Message frequency varies based on Town notification activity.
  • Reply STOP to any message to cancel at any time. You will receive a final confirmation message and no further texts.
  • Reply HELP to any message for help, or contact the Town at (603) 859-2091 or ndadmin@newdurhamnh.us.
  • Consent to receive SMS is not a condition of receiving any Town service. The same notifications are available by email and on the Town website.
  • Carriers are not liable for delayed or undelivered messages.
  • See our Privacy Policy for how your mobile information is used and protected.

5. Subscriber Obligations

  • Provide accurate contact information and keep it current.
  • Do not subscribe using someone else's email address or phone number.
  • Use the opt-out instructions ("unsubscribe" link for email, reply STOP for SMS) to stop messages at any time.

6. How We Operate the Service

  • We use the Service only for official, non-marketing Town notifications.
  • We confirm each subscriber's opt-in before sending SMS messages.
  • We comply with applicable laws and carrier requirements, including the TCPA and CTIA messaging principles.
  • We do not sell, rent, or share subscriber contact information for marketing or promotional purposes.

7. Prohibited Conduct

You may not use the Service to submit false information, to enroll others without their consent, or for any unlawful, harassing, or fraudulent purpose.

8. Intellectual Property

The Service platform, software, and TownCloud Broadcast branding belong to TownCloud or its licensors. Town seals, names, and content belong to the Town of New Durham, NH.

9. Disclaimers and Limitation of Liability

The Service is provided "as is." We aim for reliable delivery but do not guarantee uninterrupted service and are not responsible for carrier outages, internet failures, or events beyond our control. Notifications are for informational purposes; in an emergency, call 911. To the fullest extent permitted by law, neither the Town nor TownCloud is liable for indirect, incidental, or consequential damages arising from use of the Service.

10. Termination

We may suspend or remove any subscription that violates these Terms or is used to abuse the Service. You may end your subscription at any time by unsubscribing.

11. Governing Law

These Terms are governed by the laws of the State of New Hampshire. Any dispute will be resolved in the state or federal courts serving Strafford County, New Hampshire.

12. Changes to These Terms

We may update these Terms. The revised version will be posted on this page with an updated "Last Updated" date. Continued use of the Service after changes constitutes acceptance.
